These Terms & Conditions (“Terms”) govern your access to and use of www.c71pulse.ae (the “Site”) and your purchase of products from C71Pulse.

The Site is operated by C 71 PULSE TRADING L.L.C (“C71Pulse”, “we”, “us” or “our”), a limited liability company established in Dubai, United Arab Emirates, under Commercial Licence No. 1263617.

By accessing or using the Site or placing an order, you agree to these Terms and the policies referred to in them.

Nothing in these Terms excludes, restricts or limits any consumer right or remedy that cannot lawfully be excluded, restricted or limited under applicable law.

1. About C71Pulse

C71Pulse operates an online retail business offering sportswear, apparel and related products.

Our online store is operated through Shopify.

2. Eligibility and Customer Accounts

You must have the legal capacity required under applicable law to enter into a purchase transaction.

Where a person does not have the required legal capacity to independently enter into a transaction, the transaction should be made or authorised by a parent, guardian or other legally authorised person as required by applicable law.

Customers may be able to purchase products using guest checkout or through a customer account.

If you create an account, you are responsible for:

providing accurate and current information;
maintaining the confidentiality of your account credentials; and
notifying us if you reasonably believe your account has been accessed or used without authorisation.

You must not use another person's account without appropriate authorisation.

3. Product Information

We take reasonable care to ensure that product descriptions, images, specifications, prices and other information displayed on the Site are accurate.

However:

product colours may appear differently depending on photography, lighting, screen settings and device characteristics;
measurements and sizing information may be approximate;
product packaging or presentation may change;
minor variations may occur where they do not materially alter the product; and
product availability is subject to stock.

Customers should review available product descriptions, sizing information and other relevant information before placing an order.

Nothing in this section limits your rights in relation to products that are defective, damaged, incorrectly supplied, unsafe or otherwise fail to conform to applicable legal requirements.

4. Prices, Taxes and Charges

Prices are displayed on the Site in the currency indicated at the time of purchase.

C71Pulse is not currently registered for UAE VAT and does not currently charge UAE VAT on its UAE sales.

If our VAT status changes, we may update our prices, invoices, checkout and related disclosures in accordance with applicable requirements.

For deliveries to GCC countries outside the UAE, shipping charges, import VAT, customs duties, clearance arrangements and other applicable charges are handled as described in our Shipping & Delivery Policy.

The total amount payable by the customer will be displayed as part of the checkout process before the order is submitted.

5. Placing an Order

By submitting an order through the Site, you are offering to purchase the selected products subject to these Terms.

You are responsible for checking your order before submission, including:

products;
sizes and other selections;
quantities;
shipping address;
contact details; and
other order information.

After an order is submitted, you may receive an automated acknowledgement or confirmation.

An automated acknowledgement that we have received your order does not necessarily mean that the order has been finally accepted.

We may verify relevant information including product availability, payment authorisation, delivery information and suspected fraudulent or unauthorised activity before fulfilling an order.

6. Order Acceptance and Cancellation by C71Pulse

We may decline or cancel an order where reasonably necessary, including where:

a product is unavailable;
payment cannot be authorised or completed;
material information supplied with the order is inaccurate;
we reasonably suspect fraud, misuse or unauthorised activity;
there is a material pricing, product or technical error;
we cannot deliver to the address provided;
applicable legal or regulatory requirements prevent fulfilment; or
another legitimate reason prevents us from fulfilling the order.

Where we cancel an order after payment has been successfully received, the amount properly due back to the customer will be refunded through the applicable payment method.

Nothing in this section allows C71Pulse to cancel an accepted order arbitrarily or in a manner inconsistent with applicable consumer-protection requirements.

7. Customer Cancellation Requests

We will try to accommodate cancellation requests where reasonably possible.

Once an order has entered fulfilment or has been dispatched, cancellation may no longer be operationally possible. In that case, the customer may need to follow the applicable return procedure after receiving the order.

Any return or refund will be handled in accordance with our Refund & Return Policy and applicable law.

Nothing in this section limits any cancellation, return or refund right available under mandatory applicable law.

8. Payment

Payment must be completed through the secure checkout provided through our Shopify store and the applicable payment provider.

Available payment methods may include credit or debit cards and other payment methods displayed at checkout, such as Apple Pay, Google Pay, PayPal or Tabby, depending on availability, country, device, provider requirements and customer eligibility.

The payment methods actually displayed at checkout at the time of purchase are the methods available for that transaction.

C71Pulse may receive transaction-related information necessary to administer an order. Customers should not provide sensitive payment credentials through ordinary customer-support channels.

C71 AI Is Not a Payment Channel

C71 AI is not designed to request or process:

complete payment card numbers;
CVV/CVC or other card security codes;
card expiry dates;
payment OTPs or PINs;
Apple Pay credentials;
online-banking credentials;
banking passwords or authentication codes; or
similar sensitive payment credentials.

Do not provide this information through C71 AI, email or WhatsApp.

Payments must be completed only through secure Shopify checkout and the applicable authorised payment provider.

9. Promotions and Discount Codes

C71Pulse may occasionally offer promotions, discount codes, special offers or other promotional benefits.

Any promotion may be subject to specific eligibility requirements, validity periods, product restrictions, availability or other conditions communicated with the promotion.

Unless otherwise stated in the applicable promotional terms:

promotional benefits apply only during the stated promotional period;
discount codes must be entered correctly at checkout where required;
discounts cannot ordinarily be applied retrospectively to completed orders; and
promotional offers have no cash value.

Specific promotional terms displayed with an offer will apply to that promotion together with these Terms.

C71Pulse may amend or withdraw a promotion prospectively where reasonably necessary, but doing so will not affect an order already validly accepted under that promotion except where permitted or required by applicable law.

10. Shipping and Delivery

C71Pulse currently delivers within the United Arab Emirates and selected GCC countries.

Shipping destinations, charges, estimated delivery times, customs and import arrangements, tracking information and other delivery conditions are set out in our separate Shipping & Delivery Policy.

The Shipping & Delivery Policy published on the Site forms part of these Terms and applies to orders placed through C71Pulse.

Delivery times are estimates unless expressly stated otherwise.

Nothing in our Shipping & Delivery Policy or these Terms excludes, restricts or limits any mandatory right or remedy available to customers under applicable law.

11. Returns and Refunds

Returns, refunds and related procedures are governed by our separate Refund & Return Policy.

The Refund & Return Policy published on the Site forms part of these Terms and explains matters including:

return eligibility;
the applicable return period;
how to request a return;
inspection of returned products;
refunds;
damaged, defective or incorrectly supplied products; and
other applicable return conditions.

Customers should review the Refund & Return Policy before completing a purchase.

Nothing in the Refund & Return Policy or these Terms excludes, restricts or limits any consumer right or remedy that cannot lawfully be excluded, restricted or limited.

12. Warranty and Defective Products

C71Pulse currently provides a 90-day commercial warranty covering manufacturing defects.

If you believe a product has a manufacturing defect, please contact:

We may request reasonable information necessary to assess the claim, such as:

your order number;
photographs or video of the issue;
a description of the suspected defect; and
other information reasonably necessary to assess the product.

The 90-day commercial warranty is additional to and does not exclude, reduce or replace any mandatory consumer right or remedy available under applicable law.

The commercial warranty does not ordinarily cover normal wear and tear, misuse, accidental damage, improper care or damage resulting from use contrary to reasonable product-care instructions, except where applicable law provides otherwise.

13. C71 AI Customer Assistant

C71Pulse may provide an artificial intelligence-powered customer assistant known as C71 AI.

C71 AI is intended to assist customers with matters such as:

product information;
product discovery;
shopping assistance;
website navigation;
general commerce questions; and
customer-support enquiries.

C71 AI generates automated responses using artificial intelligence.

Although we take reasonable steps to improve the quality and reliability of C71 AI, AI-generated responses may occasionally be incomplete, inaccurate or outdated.

Customers should verify important information against the applicable product page, checkout, order confirmation and current policies published on the Site.

No Authority to Change Contractual Terms

C71 AI does not independently have authority to:

amend these Terms;
change an accepted order;
waive a payment obligation;
create a refund entitlement not otherwise available;
override the Shipping & Delivery Policy;
override the Refund & Return Policy;
alter a product warranty; or
otherwise create a binding contractual commitment on behalf of C71Pulse merely by generating an automated response.

Where a C71 AI response appears inconsistent with the Site, checkout, an accepted order or a published C71Pulse policy, please contact C71Pulse for clarification.

Payments

C71 AI is not a payment channel.

Do not provide card numbers, CVV/CVC, card expiry dates, OTPs/PINs, Apple Pay credentials, banking credentials or similar sensitive payment information through C71 AI.

Payments must be completed only through secure Shopify checkout and applicable authorised payment providers.

The collection and processing of information associated with C71 AI is explained in our Privacy Policy.

14. Intellectual Property

Unless otherwise stated, the Site and its content are owned by or licensed to C71Pulse or the relevant rights holder.

This may include:

the C71Pulse name and branding;
logos;
product designs;
photographs;
graphics;
videos;
text;
website design;
product descriptions; and
other original content.

The Site may be used for personal, lawful and non-commercial shopping and informational purposes.

Except where permitted by applicable law or expressly authorised by the relevant rights holder, you must not reproduce, distribute, modify, commercially exploit, republish, sell, license or create derivative works from protected Site content.

Nothing in these Terms transfers ownership of C71Pulse intellectual property to a Site user or customer.

15. Prohibited Use

You must not use the Site, customer accounts, C71 AI or other C71Pulse services to:

engage in unlawful or fraudulent activity;
submit deliberately false or misleading information;
impersonate another person;
interfere with the operation or security of the Site;
attempt to obtain unauthorised access to accounts, systems or data;
introduce viruses, malicious code or other harmful technology;
scrape, harvest or extract data in an unauthorised manner;
interfere with another customer's use of the Site;
infringe intellectual-property, privacy or other legal rights;
misuse promotional offers;
misuse C71 AI or other automated systems; or
use the Site in a manner prohibited by applicable law.

We may take reasonable steps to prevent, investigate or respond to suspected prohibited activity, including restricting access where reasonably necessary.

16. Errors, Inaccuracies and Availability

Despite reasonable efforts to maintain accurate information, the Site may occasionally contain typographical, technical, pricing, product, availability or other errors.

Where an obvious or material error affects an order, C71Pulse may contact the customer to explain the issue and, where legally permissible, provide the option to proceed on corrected terms or cancel the affected order.

If an affected order is cancelled after payment has been received, the amount properly due back to the customer will be refunded.

Nothing in this section permits C71Pulse to retrospectively change an accepted transaction merely because different commercial terms later become preferable.

Mandatory consumer rights remain unaffected.

17. Third-Party Services and Links

The Site may contain links to, or interact with, third-party services such as payment providers, logistics providers, social-media platforms and other external services.

Independent third-party services may be governed by their own terms, privacy policies and operating rules.

C71Pulse does not control an independent third-party website merely because the Site contains a link to it.

Nothing in this section excludes responsibility that C71Pulse cannot lawfully exclude under applicable law.

18. Privacy

Our collection, use and processing of personal data is governed by the separate C71Pulse Privacy Policy.

The Privacy Policy includes information concerning customer and order data, Shopify, payment-related processing, cookies and analytics, communications, C71 AI and OpenAI, international data transfers, data retention and applicable privacy rights.

The current Privacy Policy published on the Site should be read together with these Terms.

19. Liability

Nothing in these Terms excludes or limits any liability, warranty, consumer right or remedy to the extent that it cannot lawfully be excluded or limited.

C71Pulse remains responsible for its obligations under applicable law.

To the maximum extent permitted by applicable law, C71Pulse will not be responsible for indirect or consequential losses arising from circumstances for which liability may lawfully be excluded.

We are not responsible for delays or failures caused solely by circumstances genuinely outside our reasonable control, subject to any rights or remedies available to the customer under applicable law.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct or any other liability that applicable law prohibits us from excluding or limiting.

20. Changes to These Terms

We may update these Terms from time to time to reflect changes to:

our business operations;
products or services;
Site functionality;
payment or delivery arrangements;
C71 AI;
applicable laws or regulatory requirements; or
other legitimate operational requirements.

The current version will be published on the Site with its applicable Last Updated date.

Changes apply prospectively unless applicable law requires otherwise.

An update to these Terms will not retrospectively remove rights arising from an order already accepted under an earlier version, except where required by law or agreed with the customer.

21. Governing Law and Jurisdiction

These Terms and purchases made from C71Pulse are governed by the applicable laws of the United Arab Emirates and the Emirate of Dubai.

Subject to any mandatory consumer right to bring a complaint or claim before another competent authority or forum, disputes relating to these Terms or purchases from C71Pulse shall be subject to the jurisdiction of the competent courts of Dubai, United Arab Emirates.

Nothing in this section prevents C71Pulse and the customer from attempting to resolve a complaint or dispute amicably before commencing formal proceedings.

These Terms should be read together with the following C71Pulse policies:

The current versions published on www.c71pulse.ae are the authoritative customer-facing versions.

Where a policy contains more specific provisions concerning its subject matter, those provisions apply to that subject matter together with these Terms, subject always to applicable law.
